AN ORDINANCE ADOPTING THE WESTFIELD STREET REDEVELOPMENT PLAN

 

Body

Section 1. The “Westfield Street Redevelopment Plan,” attached hereto, is hereby incorporated herein by this reference, and is hereby adopted.

 

Section 2. The area covered by the Westfield Street Redevelopment Plan is within Redevelopment Area 4 and originates at the intersection of Westfield and Harrison Street, traveling north to the intersection of Harrison Street with Wilson Street, then traveling east to the intersection of Wilson Street with Elmwood Avenue, then traveling south on Elmwood Avenue to the intersection with Westfield Street, then traveling west to the point and place of beginning, all as is more specifically described in Section (1) of the attached Redevelopment Plan.

 

Section 3.  The City Council hereby finds that the Redevelopment Plan project area is blighted and substandard, evidencing arrested blighted conditions, slum blighted conditions and deteriorated blighted conditions as defined in R.I. Gen. Laws Section 45-31-8, including without limitation deterioration of structures, vandalism and graffiti, tax delinquencies, and vacant, unmaintained and overgrown lots littered with abandoned property, such that the area requires clearance, replanning, redevelopment, rehabilitation and/or improvement, all as more specifically provided in Section (2) of the attached Redevelopment Plan.

 

Section 4.  It is the purpose and intention of the City Council in adopting this Ordinance to foster the elimination and prevention of blighted and substandard conditions in the project area which is the subject of the attached Redevelopment Plan, which shall protect and promote the health, safety, morals and general welfare of the aforesaid project area and the West End Redevelopment Area, all as more specifically provided in Section (12) of the attached Redevelopment Plan.

 

Section 5.  The City Council hereby finds that the Westfield Street Redevelopment Plan is feasible and conforms to the Comprehensive Plan for the City of Providence, as more specifically provided in Section (7) of the attached Redevelopment Plan, and that if the attached Redevelopment Plan is implemented as provided it would promote the public health, safety, morals and welfare of the City of Providence, and would effectuate the purposes set forth in chapters 31, 32 and 33 of Title 45 of the General Laws of the State of Rhode Island.

 

Section 6.  Currently, the attached Redevelopment Plan does not call for any expenditures of funds outside of the existing funds on hand of the Providence Redevelopment Agency, and therefore no authorization for the appropriation of funds by the City Council is required in connection with the implementation of the attached Redevelopment Plan.

 

Section 7. The City Council finds that the attached Redevelopment Plan does not call for the opening, closing, widening, or changing the grade of existing streets or alleys or for any modification of the existing street layout in the project area, that the attached Redevelopment Plan does not call for the condemnation of any real property, and does not call for the provision of financial aid from the federal government, and therefore no further findings are required as to these matters.

 

Section 8. The City Council finds that the attached Redevelopment Plan makes adequate provision for the retention of controls and the establishment of any restrictions or covenants which may run with real property sold, leased or otherwise disposed of, all as more specifically set forth in Section (9) of the attached Redevelopment Plan.

 

Section 9.   The City Council hereby determines that it is in the best interest of facilitating the implementation of the attached Redevelopment Plan to provide, and it is hereby provided, pursuant to R.I. Gen. Laws Section 45-32-40, that all real property in the aforesaid project area acquired by the Providence Redevelopment Agency for redevelopment purposes shall be exempted from real property taxation by the City of Providence for the period of the ownership of such real property by the Providence Redevelopment Agency.

 

Section 10. This Ordinance shall take effect on its passage and shall be filed with the City Clerk who is hereby authorized and directed to forward a certified copy of this ordinance and the attached plan to the Providence Redevelopment Agency.
