              The Following Appointment is re-submitted for consideration.  Due to unavoidable circumstances said appointee was unable to attend the hearing of the Finance Committee on January 13, 2010, and in accordance with protocol was denied without prejudice:

ORDINANCES SECOND READING

 

              The Following Ordinances were in City Council January 7, 2010, Read and Passed the First Time and are Severally Returned for Passage the Second Time:

 

              An Ordinance Amending Chapter 18 ½, “Police,” Section 18½-2, “Providence External Review Authority (PERA).” 

 

              COUNCILMAN HASSETT: Mr. President, there are three minor amendments to item 16 which is the PERA Ordinance, and I would yield to the sponsor Councilman Yurdin to expand on that.

             

              COUNCILMAN YURDIN: Thank you.  This is a substitution for item number 16, and there are a couple of minor changes.  On page two, there is a term that’s been added in Section 1(a) which modifies who will be able to be hired as the Executive Director, and the language that’s added basically states: “…and/or has substantial experience with public administration…”

So, this expands the scope of who would be able to be hired for that position.  The second change is on page number five in Section H(1) which is the Executive Director section.  There was language in there that probably shouldn’t have been there in the first place which said “and participate in,” which basically set functions of allowing the Executive Director to participate in internal affairs investigations when in fact their responsibility is to actively monitor.  So, that was a suggestion we took and deleted.

             

              COUNCILMAN HASSETT: That’s Section H(1)?

 

              COUNCILMAN YURDIN: There was language removed in there that used to state “and participate in”.  It’s no longer in this.  It’s been stricken.  The next change is in the section that relates to reporting, bi-annual reports so Section J, and there is language, which is on the last line that says “…it shall further detail all of the authority’s expenditures...”  This would require that the bi-annual reports have more detail about what the authority actually spends and then the final change is in on the last page Section 2, which we have changed the expiration period to 90 days for the expiration of the current board members, but also wanted to add language to the section that would state upon the earlier of the following events.  One, 90 days of adoption of this ordinance or two, upon the appointment of the majority of the new board members and that would continue to state that the term of all members appointed to and/or by the Authority prior to passage of this ordinance shall expire.  Then the final sentence should read, “…the term of any new appointments made pursuant to 18½ 2 (c) shall take effect upon expiration of the prior board members terms...”  Those are the changes and they’re minor changes and I would urge passage of this as amended.

The Honorable Bruce Sundlun, in recognition of the celebration of the special occasion of his ninetieth birthday, born January 19, 1920.

PERSONAL EXPRESSION

 

              COUNCILMAN NARDUCCI Requests the privilege of the floor to speak on a Point of Personal Expression and states:

 

              “I think it’s very important to recognize two people that we lost in the City of Providence this week and one of them is Lawrence “Duckie” Covington, Jr. and the other is Albert Melise, Jr.  These two gentlemen were very fine gentlemen.  They did a lot for the youth in our area.  As far as Mr. Covington, Councilman Jackson also knows who this gentlemen is, he used to take the kids fishing and some of the kids he would take fishing probably would have never had a chance to go if it wasn’t for him.  Albert Melise was a coach in our little league for many years and helped many kids in the North End of Providence.  I would really appreciate it if we could take a moment of silence for the loss of Lawrence “Duckie” Covington, Jr. and Albert Melise, Jr.  Thank you.”
